By Delhi Law Advocates | Criminal Litigation Team
The deprivation of personal liberty is a grave matter under the Constitution of India. Article 21 guarantees that no person shall be deprived of their life or personal liberty except according to the procedure established by law.
At Delhi Law Advocates, our criminal defense team rigorously challenges the investigating agencies when they flout these procedural safeguards. Understanding the statutory mandates of the Bharatiya Nagarik Suraksha Sanhita (BNSS) is vital for defending against arbitrary state action.
Codification of the D.K. Basu Guidelines
The historic Supreme Court judgment in D.K. Basu v. State of W.B. laid down preventive measures to curb custodial torture and illegal detentions. These guidelines are now deeply embedded within the BNSS framework.
Mandatory Procedural Checks
- Preparation of Arrest Memo (Sec 46): Investigating officers must wear visible name tags with their designations. An arrest memo must be drafted contemporaneously at the arrest site, acting as a crucial piece of evidence regarding the timeline of detention.
- Right to Legal Counsel (Sec 35): The arrestee retains the statutory right to meet an advocate of their choice during interrogation, ensuring that statements are not extracted under coercion.
- Medical Examination (Sec 53): The mandatory medical examination by a government medical officer prevents the police from inflicting undocumented injuries. A copy of the medical report must be furnished to the arrestee.
- Production Before Magistrate (Sec 58): The police are constitutionally barred from detaining an individual for more than 24 hours (excluding journey time) without presenting them before a Judicial Magistrate.
Remedies for Unlawful Detention
If the police violate these statutory mandates, the arrest becomes void ab initio (illegal from the start). Our litigation strategy in such scenarios includes:
- Habeas Corpus Petitions: Moving the Delhi High Court to immediately produce the illegally detained person.
- Bail Applications: Leveraging procedural lapses as prime grounds for securing Regular Bail before the Sessions Court or High Court.
- Departmental Action: Initiating contempt proceedings and demanding departmental inquiries against erring officers.
Effective criminal defense starts the moment the arrest occurs. Contact Delhi Law Advocates immediately if your civil liberties are under threat.
