- Education is a Disqualification for Idleness: If a husband is highly educated (holding degrees like an MBA, B.Com, or Engineering) and is physically healthy, the court will presume he is fully capable of earning his own living. The judge will tell him: “You are an able-bodied man. Go out, find work, and support yourself. You cannot sit idle simply to live off your wife’s hard work.”
- The Job-Quitting Strategy Fails: Some husbands deliberately resign from their well-paying corporate jobs as soon as a matrimonial dispute begins, trying to show a zero bank balance to avoid paying child support or to demand money from their wives. Judges see right through this trap. The court will calculate maintenance based on what the husband is capable of earning, not his manufactured unemployment.
- The Absolute Exception: A husband will only receive financial maintenance if he can produce undeniable proof of total physical or mental disability. If he is suffering from a permanent illness or an injury that completely stops him from doing any job for the rest of his life, only then will the court order an earning wife to provide financial assistance.
