Historically, litigation dragged on over whether the condition of maintenance needed to be explicitly documented in the registered deed. Recent jurisprudence from the Supreme Court (Urmila Dixit, 2025) and the Delhi High Court has clarified that welfare legislation must be interpreted liberally. The Courts recognize that an “implied condition” of care exists whenever property is transferred within a family based on natural love and affection.
