Understanding Section 23(1) of the Act
Section 23(1) serves as a deterrent against children who coerce or sweet-talk their parents into relinquishing property rights, only to abandon them later.
The law empowers the Maintenance Tribunal to declare any property transfer “void” if the transferee refuses to provide basic physical needs and amenities to the senior citizen.
The “Implied Condition” Precedent (2025 Updates)
Historically, litigation dragged on over whether the condition of maintenance needed to be explicitly documented in the registered deed. Recent jurisprudence from the Supreme Court (Urmila Dixit, 2025) and the Delhi High Court has clarified that welfare legislation must be interpreted liberally. The Courts recognize that an “implied condition” of care exists whenever property is transferred within a family based on natural love and affection.
