By Delhi Law Advocates | Civil & Property Litigation Team
Disputes over family inheritance often fracture relationships and lead to protracted civil litigation. At Delhi Law Advocates, our property litigation desk frequently handles complex cases where legal heirs are denied their rightful shares by dominant family members.
Understanding the legal standing of the property is the first step in any succession dispute.
Defining Coparcenary Property
The core of Hindu inheritance law relies on the concept of the “Coparcenary”—a narrower body within a Hindu Undivided Family (HUF) consisting of individuals who acquire an interest in the coparcenary property by birth.
As per the Hindu Succession Act, 1956 (External Link), a property is considered ancestral only if it has devolved unpartitioned through four generations. Once an ancestral property is legally partitioned among the coparceners, the share received by each individual becomes their self-acquired property in the hands of their own descendants.
The Rights of Daughters Post-2005
The 2005 amendment to Section 6 of the Hindu Succession Act was a watershed moment for gender equality in India. It granted daughters the status of coparceners by birth, identical to sons.
The Supreme Court’s definitive ruling in Vineeta Sharma v. Rakesh Sharma (2020) laid to rest previous ambiguities, stating that the daughter’s right is absolute, regardless of whether her father was alive on September 9, 2005 (the date of the amendment).

Initiating a Partition Suit in Delhi
When negotiations fail, and a co-owner wishes to sever their share from the joint family property, a Suit for Partition and Separate Possession must be instituted.
Our Litigation Strategy Includes:
- Legal Notice: Drafting a comprehensive notice demanding partition by metes and bounds.
- Injunctions: Moving applications under Order 39 Rules 1 & 2 of the CPC to secure a stay order, preventing the unauthorized sale or creation of third-party rights on the disputed property during the pendency of the suit.
- Preliminary and Final Decrees: Guiding the case from the preliminary decree (declaring the shares) to the final decree (actual physical division or sale of the property).
If your inheritance rights are being suppressed, timely legal intervention is critical. Reach out to our expert property lawyers today (Internal Link) to evaluate your claim and secure your rightful share.
