The D.K. Basu Guidelines: A Checklist for Arrest
Whenever we represent a client who has been arrested, we first check if the police followed the D.K. Basu Guidelines. Any violation gives us strong grounds for bail and action against the police.
The “Inspection Memo”
Did you know? At the time of arrest, you can request an inspection of your body.
- If you have no injuries, it is recorded.
- If you are produced in court later with injuries, it PROVES that the injuries were inflicted during police custody.
New Handcuffing Laws in India (2024)
The new Bharatiya Nagarik Suraksha Sanhita (BNSS) has introduced Section 43(3).
While it allows handcuffing for serious offenders (Terrorists, Murderers, Rapists), it does NOT give police a free pass to handcuff everyone.
We Challenge Illegal Handcuffing:
If you were handcuffed for a white-collar crime or a minor dispute just to humiliate you, we can move the High Court for compensation for violation of Article 21.
