By Delhi Law Advocates | Criminal Defense Team
Relationships are complex, and breakups are painful. However, when a breakup leads to a criminal FIR alleging “Rape on Pretext of Marriage,” the consequences are life-altering.
At Delhi Law Advocates, we specialize in defending clients against false allegations under the newly notified Section 69 of the Bharatiya Nyaya Sanhita (BNS).
Understanding Section 69 BNS (The New Law)
Section 69 BNS replaces the interpretation of Section 375/90 of the old IPC. It explicitly states that:
- Whoever, by deceitful means or making a false promise to marry, has sexual intercourse with a woman…
- Shall be punished with imprisonment up to 10 years and a fine.
Key Definition: “Deceitful means” includes false promise of employment or promotion, or marrying after suppressing one’s identity.
Our Defense Strategy in Court
We defend our clients across Dwarka, Saket, Patiala House, and Rohini Courts by establishing that the consent was voluntary and not obtained by fraud.
1. The “Passive Submission” vs. “Active Consent” Argument
We prove that the prosecutrix (complainant) was an adult who understood the consequences of her actions. If she engaged in the act repeatedly over a long period, it indicates “Active Consent” rooted in love, not a misconception of fact.
2. Examining the Conduct
Did the complainant introduce the accused to her family? Did they live together? Did they share finances? These factors help us prove a “De facto Marriage” or a serious relationship, negating the claim of “deceit.”
3. Delay in FIR
In many cases, the FIR is filed days or weeks after the breakup. We use this “unexplained delay” to argue that the complaint is an afterthought motivated by anger or revenge.
