Under Section 138 of the Negotiable Instruments Act, 1881, the law gives you a strong legal remedy to recover money, but only if you follow strict timelines.

The 3 Key Timelines in Cheque Bounce Cases
If a cheque is dishonoured due to “insufficient funds” or “signature mismatch”, you must act according to these simple steps:
- Step 1: Send a Legal Notice in 30 Days: As soon as you receive the bank memo showing the cheque bounced, you must send an official Legal Demand Notice to the person who gave the cheque within 30 days.
- Step 2: Wait 15 Days for Payment: The law gives the other person 15 days from receiving your notice to pay the money. You cannot file a court case during these 15 days.
- Step 3: File Court Case Within the Next 30 Days: If the person does not pay within those 15 days, you have 30 days to file a formal complaint under Section 138 before the local Magistrate Court.

What Happens If You Miss the 30-Day Notice Period?
If you fail to send the legal notice within 30 days of receiving the bank memo, you lose the right to file a criminal complaint under Section 138 NI Act. In that case, you may only be left with a regular civil recovery suit, which can take significantly longer.
