If the family does not have the cash immediately available, the hospital administration shifts into a recovery mode, refusing to hand over the deceased person’s body until every single rupee is paid.

What Should You Do If a Hospital Refuses to Release a Body?

- Dial 112 for Direct Police Help: Call the police helpline immediately from the hospital floor. Tell the operator clearly: “The private hospital is illegally holding a deceased body over a billing dispute and committing an offense.” When the police arrives, the hospital management usually clears the release files immediately to avoid a formal criminal case.
- Submit a Written Request: Hand over a short, written letter to the senior hospital manager, demanding the immediate handover of the body for final rites. State that you are ready to receive the bill copy for review, but they must release the body first.
- Involve a Lawyer for an Emergency Court Order: If the hospital remains stubborn, your lawyer can file an emergency petition directly before the High Court. The courts look at these violations with extreme seriousness and can issue immediate orders within a few hours to free the body and penalize the hospital directors.
